APPROVES
the above mentioned building to carry out catering activity including:
preparing meals starting from raw material to finished meals without using eggs which require pretreatment, providing catering services with own means of transport in time guaranteeing the delivery to the destination, the quality of the foodstuffs and meals must not be changed after the delivery
JUSTIFICATION
The sanitary inspection was carried out at the request of A. Sokół from 29th July 2011 with relation to his intention of starting the catering business. The design documentation has received a positive opinion from the State District Sanitary Inspectorate in Olkusz in terms of hygiene and health requirements with reservations as in the decision of 17th February 2005, sign NZ432/21/2005. After consultation the author of the design introduced some changes and decided that they do not differ substantially from the original design. The unidirectionality of production was ensured in the company. Małopolski Wojewódzki Inspektor Sanitarny [Malopolskie Provincial Sanitary Inspector] in Cracow consented to the deviation from the regulations concerning the non-standard height of the rooms in the company with the decision of 7th May 2001, sign WSE.NZ-437/277/2001. The company is situated in a detached building, with residential ground-floor, connected to a water supply and sewage system, gas supply system and electricity network. It has four independent entrances: for the delivery of raw material, staff, to the room where the dishes are washed and finally a separate entrance for the dispatch of the finished products. The total floor area is 141,3m2. In the building there is a proper kitchen, room for the pretreatment of vegetables and fruits, dishwash area, refrigerators and freezers for perishable commodities, storage of fruits and vegetables, fish
processing room, refrigerators for the finished product, finished product dispatch room, sanitary and social accommodation for the staff and a storeroom. The building has necessary fixtures, fittings and equipment. Appropriate conditions have been ensured for washing and scalding of tableware. Appropriate conditions have been ensured for washing food and kitchen utensils. Appropriate conditions have been ensured for washing hands by the staff- sinks in the kitchen, in the toilet, in the social room and in the finished dispatch room. The building has access to cold and warm water.
The building has natural and artificial lightning. The building has inlet and extract gravity and mechanical ventilation. The building is protected from pests. Transport carried out by own means of transport: SEAT INCA, registration number KOL 82G4 which meets the requirements of annex II vol. IV regulation of (WE) No 852/2004 of The European Parliament and The Council of Europe of 29th April 2004 concerning the hygiene of foodstuffs (Dz.Urz. UE. I 139 of 30th April 2004, page 1) or by external companies.
It was stated that the building meets the health and hygiene requirements.
It is possible to appeal against this decision in Małopolski Wojewódzki Inspektor Sanitarny [Malopolskie Provincial Sanitary Inspector] ; 31-202 Kraków, 76 Prądnicka Street through State District Sanitary Inspectorate in Olkusz; 32-300 Olkusz Al. 1000-lecia 13 A, within 14 days of receipt.

DECISION
State District Sanitary Inspectorate in Olkusz operating under Article 12, Act I and Article 3 Act of 14th March 1985 concerning the State Sanitary Inspection /Dz. U. [Polish Journal of Laws] of 2006 vol.122, item 851 with amendments/, in conjunction with Article 56, Act of 7th July 1994 – Construction Law /Dz. U. [Polish Journal of Laws] of 2006 vol.156, item 1118 with amendments/, and regulations of the Minister of Infrastructure of 12th April 2002 concerning technical conditions that should be met by buildings and their location / Dz. U. [Polish Journal of Laws] vol. 75, item 690 with alternations/
after examining the application of Mr. Sokół:
Inspection was carried out at the request of Mr. Sokół with relation to the finalization of the investment including the change in the way of making use of the company and the intention of running a business in the above-mentioned building. The project was completed on the basis of the design documentation, as agreed in terms of hygienic and health requirements by State District Sanitary Inspectorate in Olkusz in the decision of 17th February 2005, sign: PSSE.NZ-432/21/2005.
In the inspected building there is a proper kitchen, room for the pretreatment of vegetables , dishwash area, storage of fruits, vegetables, fish and dry products, freezers and fridges where meat and cured meats are kept, fridges where finished products are kept, servery,
sanitary and social accommodation for the staff and room where cleaning supplies are kept.
The total floor space of the building is about 141m2.
Changes in the accommodations and the equipment made by the author of the project, mgr inż. Adam Marchajski (building qualifications No 683/82) on 18th July 2011 do not differ substantially from the original design. In the original design there was a storage of vegetables and fruits in the place where there is a freezer now and the storage of fruits and vegetables is in the place of a storage of dried products. The room where fruits and vegetables are peeled was situated in the place of a storage of drinks. In the place where a room where eggs are washed and disinfected was going to be created, there is a storage of dried products. For this reason the investor madea written commitment to use eggs which do not require disinfection or pasteurized eggs. The introduced changes do not not interfere with the functional layout of
the rooms. The introduced change was about enlarging the dishwash area (spot for cleaning containers) which has improved its functionality. The investors declared their plans of employing 3 additional workers. During the inspection the following documents were presented: current water test, protocol for the condition of the ventilation ducts in the building, and the decision of starosta of Olkusz approving the building permit No 399/2003 of 6th October 2003, sign: WA.7351-1-147/2003 and changed of 18th May 2005, sign: WA.7351-1/67/2005.
Małopolski Wojewódzki Inspektor Sanitarny [Malopolskie Provincial Sanitary Inspector] in Cracow consented to the deviation from the regulations concerning the non-standard height of the rooms in the company with the decision of 7th May 2001, sign WSE.NZ-437/277/2001.
Taking all the above mentioned points into consideration it is stated as in the decision.
